What would happen here?

In cases of criminal libel or slander, where they can ign jail time, in California, once law enforcement deems that a statement is false in court, (a statement that led to a police investigation) is the party who said it immediately charged with criminal libel or slander? Or does the opposing party still have to file a lawsuit/press charges in order for something to happen to them?
